Terms of Service

These terms are the agreement between you and PixAfar for use of our website and mobile apps. By creating an account or using the service, you accept them. If you do not accept them, please do not use PixAfar.

1. Your account

You need an account to create galleries. You must be at least 13 years old. Give accurate information when you sign up, keep your password to yourself, and tell us at support@pixafar.com if you believe someone else has accessed your account. You are responsible for what happens under your account.

2. Your content stays yours

The photos, videos and text you upload remain yours. We claim no ownership of them.

To run the service, you give us permission to store, copy, resize and display your content — for you, and for anyone you choose to share it with. That permission exists only so we can operate PixAfar, and it ends when you delete the content or close your account, apart from copies that may briefly persist in backups.

You confirm that you have the right to upload what you upload, and that doing so does not infringe anyone else's rights.

3. Public sharing

Marking a gallery public and sharing its link makes it viewable by anyone who has that link, with no account required. Share links are unlisted, not secret. Make a gallery private again to stop its link working.

4. Acceptable use — zero tolerance for objectionable content

PixAfar has no tolerance for objectionable content or abusive behavior. You must not upload, share, or transmit content that:

  • is unlawful, or promotes or facilitates unlawful activity;
  • is sexually explicit, pornographic, or sexualizes minors in any way;
  • is hateful, harassing, bullying, threatening, or attacks people on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation or age;
  • is violent, graphic, or glorifies violence or self-harm;
  • infringes copyright, trademark, privacy or any other right of another person;
  • depicts an identifiable person in a private setting without their consent;
  • is spam, fraudulent, deceptive, or contains malware;
  • impersonates another person or misrepresents your affiliation with anyone.

You also must not attempt to breach or probe the security of the service, access another user's account or content, scrape or bulk-download content, or use PixAfar in a way that degrades it for others.

5. Reporting content, and how we respond

To report content or a user that breaks these rules, email support@pixafar.com with the gallery link or share link and a short description of the problem. Reports can be sent by anyone, including people who do not have a PixAfar account.

We review every report and act within 24 hours. Where content breaches these terms we remove it, and we suspend or terminate the account responsible.

We may remove content or restrict an account at any time where we believe these terms have been broken, and we may do so without prior notice where the content is seriously harmful. Users can also block other users from interacting with them; contact us if you need this applied.

6. Availability

We work to keep PixAfar available and your content safe, but the service is provided as it is. We may change, suspend or discontinue features. We do not guarantee uninterrupted access, and we recommend keeping your own copies of photos and videos that matter to you. PixAfar is not a backup service.

7. Ending your use

You can stop using PixAfar at any time. Account Settings offers two ways to go: pause, which signs you out and hides your galleries while keeping everything you have uploaded, and delete, which permanently removes your account, your galleries and your files and cannot be undone. You can also email support@pixafar.com and we will do either for you.

Deleting your account does not cancel a PayPal subscription. Only you can do that, from Automatic Payments in your PayPal account — please cancel there too, or PayPal will keep charging you.

We may suspend or terminate an account that breaks these terms, or where required by law.

8. Disclaimers and limits

To the fullest extent the law allows, PixAfar is provided without warranties of any kind, and we are not liable for indirect or consequential losses, or for lost content, arising from your use of the service. Nothing in these terms limits liability that cannot lawfully be limited.

9. Changes to these terms

We may update these terms. When we do we will change the date at the top of this page, and we will give notice in the app or by email where the change is significant. Continuing to use PixAfar after a change means you accept the updated terms.

10. Governing law

These terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of law rules.
